STATUTE


1. General provisions

1.1. The AvocadoPB online store, available at www.avocadopb.com (hereinafter referred to as the "Store"), is operated by:

1.2. The Regulations define the rules for using the Store, placing orders, concluding and implementing distance selling contracts, and the rights and obligations of the Customer and the Seller.

1.3. A customer may be:

  • consumer,
  • entrepreneur-consumer (Article 385⁵ of the Civil Code),
  • entrepreneur (hereinafter collectively referred to as the "Customer").

2. Definitions

  • Working days – Mon.–Fri., excluding public holidays.
  • Account – Customer account in the Store enabling placing orders and viewing purchase history.
  • Product – a movable item offered in the Store, e.g. a power bank.
  • Pre-order – the ability to place an order for a Product before its physical availability.
  • Contract – a sales contract concluded at a distance between the Seller and the Customer.
  • Payment operator – an entity handling online payments (e.g. Przelewy24).
  • Carrier – a courier company or parcel locker operator delivering orders.

3. Product Information and Availability

3.1. All Product descriptions, photos and prices are for informational purposes only and constitute an invitation to conclude a contract (Article 71 of the Civil Code).
3.2. Prices are given in Polish zloty and include VAT.
3.3. Each Product is accompanied by information about availability (“Available”, “Sold Out”, “Ships from [date]”).
3.4. Pre-order products have an estimated delivery date. This may change due to circumstances beyond our control (e.g., transportation, customs, production).
3.5. The Seller reserves the right to change prices and product range; this does not affect previously placed orders.


4. Account and placing orders

4.1. The customer can make a purchase as a guest or after registering an account.
4.2. The ordering process includes:
a) selecting the Product and adding it to the cart,
b) completing the order form,
c) selection of payment and delivery method,
d) confirmation of order and payment.

4.3. Upon receipt of the order confirmation email, the Agreement is concluded.
4.4. The Seller may cancel or refuse to process an order in the event of:

  • no payment within 24/48 hours,
  • providing false or incomplete data,
  • obvious technical error (e.g. price PLN 0),
  • reasonable suspicion of fraud or attempted abuse.

4.5. The Customer is responsible for providing incorrect address details resulting in non-delivery of the shipment.
4.6. In the event of order cancellation, the Seller will refund the funds paid; the Seller is not responsible for any other consequences.


5. Payments

5.1. Available payment methods: quick transfers, payment cards, BLIK, traditional transfer, cash on delivery (e.g. Przelewy24).
5.2. Failure to pay on time = order cancellation.
5.3. Refunds are made only to the account from which the payment was made.
5.4. The Seller is not responsible for delays by banks and payment operators.


6. Delivery

6.1. Delivery within Poland and the EU – courier, parcel locker or other option available in the Store.
6.2. Standard shipping time: 1–3 business days from receipt of payment.
6.3. The customer inspects the shipment upon receipt; it is recommended to complete a damage report in the event of damage.
6.4. The Seller is not liable for delays caused by the carrier or the effects of force majeure (e.g. natural disasters, system failures, strikes).
6.5. The risk of loss/damage to the Product passes to the Customer upon delivery of the shipment to the carrier (B2B) or upon taking possession (consumer).


7. Withdrawal from the contract (returns)

7.1. The consumer and the entrepreneur-consumer have 14 days to withdraw from the contract.
7.2. Returns must be reported by email or post.
7.3. The product must be returned within 14 days, at the Customer's expense.
7.4. Refunds are made within 14 days, but may be withheld until receipt of the shipment.
7.5. Exclusions:

  • personalized products,
  • products with damaged hygiene packaging,
  • products used beyond functionality testing.

8. Complaints and warranty

8.1. Complaints should be submitted by email or post (it is advisable to include a description of the defect and photos).
8.2. Response within 14 days; no response = complaint accepted (consumers).
8.3. The Customer is obliged to securely pack the Product being complained about to avoid additional damage during transport.
8.4. The manufacturer's warranty, if any, does not limit warranty rights.


9. Seller's liability

9.1. No liability for damages resulting from:

  • improper use,
  • damage after delivery,
  • unauthorized repairs and alterations,
  • force majeure.

9.2. In B2B relationships, warranty is excluded to the fullest extent permitted by law.
9.3. In B2B relations, the Seller's liability is limited to the value of the placed order.
9.4. In B2B relations, the Seller is not liable for lost profits or indirect damages.


10. Personal data and cookies

10.1. The data controller is the Seller. Processing is carried out in accordance with the Privacy Policy.
10.2. The store uses cookies – rules in the Cookie Policy.


11. Intellectual Property

11.1. All content of the Store (texts, photos, graphics, logos, product descriptions, trademarks and branding elements) is the property of the Seller or is used legally.
11.2. Copying, distributing, modifying and using the content without the Seller's consent is prohibited.
11.3. Violations will result in civil liability, the obligation to repair damages and the payment of compensation.


12. Extrajudicial dispute resolution

12.1. The consumer may use the ODR platform: https://ec.europa.eu/consumers/odr .


13. Final provisions

13.1. Polish law applies to contracts.
13.2. The Seller may change the Regulations for important reasons (law, offer, functionality).
13.3. For orders placed before the change, the version in force on the date of purchase shall apply.
13.4. The amendment to the Regulations does not affect ongoing complaint or refund procedures.
13.5. Disputes in B2B relations shall be resolved by the court having jurisdiction over the Seller's registered office.
13.6. The Regulations are available in electronic form and may be saved by the Customer.
